GENERAL TERMS AND CONDITIONS FOR EMPLOYMENT APPLICATION

If selected, I understand that a probationary period of three (3) months would be required and I agree to the following:

1)Will abide by the rules of employment of Dix Welding Works.
2)Will work overtime and shift work as required.
3)Will use safety equipment as directed.

In signing this application for employment form, I declare that the above information is true and correct. I also authorise Dix Welding Works the investigation of all statements contained herein.

GENERAL TERMS AND CONDITIONS OF COMMERCIAL CREDIT ACCOUNT

These terms and conditions shall apply to the exclusion of all others including any terms and conditions of the customer (whether on the Customer’s order form or otherwise). The Customer acknowledges that these terms and conditions embody the whole agreement between parties and agree to be bound by them.

Standard trading terms are strictly 30 days and payment is due by the end of the month following invoice date.

The Customer acknowledges that time is of essence with regard to payment and that any breach of this term will enable the company to exercise all of its rights contained here including (but without in any way limiting its rights) the right to cancel further credit and to take legal action for the recovery of all sums outstanding.

Any contract arising on the supply of goods invoiced by Dix Welding Works as Supplier will include the Following conditions;

- Property in and title to goods provided from time to time shall remain with the supplier until payment is made by the Customer for all amounts due to the supplier.

- If a bona fide dispute arises as to ownership of goods in possession of the customer, then it shall be presumed that those goods are owned by the Supplier unless the Customer can prove otherwise.

- The risk of loss or damage to goods supplied shall be entirely at the risk of the customer upon delivery To the customer.

Should payment remain outstanding beyond the Company’s payment terms as outlined in clause 2, the customer is liable for all costs including legal costs (on a Solicitor/own client basis) and mercantile agents fees incurred by the Company in recovering the amount outstanding.

The purchase price in relation to goods is payable net and payment of the price of the goods must be made on or before the 13th day of the month next following the delivery of the goods unless other terms of payment are expressly stated in these conditions in writing.

The Customer will be deemed to have accepted goods as being in accordance with its order unless it the Company in writing of its claim within 14 days of receipt of goods.

The supplier reserves the rights in relation to the goods until all accounts owed by the buyer to the seller are fully paid:

A. Ownership of the goods;
B. To enter the buyer’s premises (or the premises of any associated company or agent where the goods are located) without liability for trespass or any resulting damage and retake possession of the goods; and
C. To keep or re-sell any goods repossessed pursuant to (B) above.

If the goods are re-sold, or products manufactured using the goods are sold, by the buyer, the buyer shall hold such part of the proceeds of any such sale as represents the invoice price of the goods sold or used in the manufacture of the goods sold in a separate identifiable account as the above seller shall be entitled to maintain an action against the buyer for the purchase price and the risk of the goods shall pass to the buyer upon delivery.

All warranties whether express or implied and whether statutory or otherwise with regard to the goods supplied by the Company as to quality, fitness for purpose or any other matter are hereby excluded except in so far as any such warranties are incapable of exclusion at law.

The Customer agrees to notify Dix Welding Works in writing of any change of ownership of the Customer within seven (7) days from the date of such change and indemnifies Dix Welding Works against any loss or damage incurred by it as a result of the Customer’s failure to notify Dix Welding Works of any change.
